Genial Link ("Genial Link," "we," "us," or "our") builds websites, online stores, apps and custom AI agents for businesses. This Privacy Policy explains how we collect, use, share and protect personal information when you visit our website, contact us by WhatsApp, webchat, phone, text message (SMS) or email, or use our services. By using our website or contacting us, you agree to the practices described in this policy.

2. Information we collect
Information you give us
- Contact details, such as your name, phone number, email address and business name.
- Message content you send through our contact form, WhatsApp, webchat, text messages, email or phone calls, including details about your business and the services you are interested in.
- Billing information, if you become a client. Payments are handled by our payment processors; we do not store full card numbers.
Information collected automatically
- Technical data, such as your IP address, browser type, device type, pages visited and the date and time of your visit.
- Cookies and similar technologies, described in section 7.
Information from others
We may receive information from messaging platforms (for example, your WhatsApp display name and phone number when you message us) and from people who refer you to us.
3. How we use your information
- To respond to your questions and requests, and to prepare quotes and proposals.
- To provide, maintain, support and improve our services.
- To schedule calls, video calls or visits that you request.
- To send service messages, such as replies, appointment confirmations and project updates.
- To send marketing messages, only where you have agreed to receive them. You can opt out at any time (see section 9).
- To protect our website and users from spam, fraud and abuse.
- To comply with legal obligations and enforce our agreements.
4. AI agents and how we handle conversations
The first reply to messages sent to us through WhatsApp, webchat, phone, text message or our contact form is usually provided by an AI agent. The AI agent detects the language you write or speak in, answers common questions, and collects the details we need to help you. A member of our team reviews these conversations and follows up personally.
- Conversations with our AI agent are stored as messages or transcripts so our team can follow up and improve the quality of our service.
- Phone calls may be recorded and transcribed. When a call is recorded, you will be told at the start of the call, and you may ask to speak without being recorded.
- You can ask to speak with a person at any time.
- We do not use your conversations to make decisions that have legal or similarly significant effects on you.
5. Text messages (SMS) and WhatsApp
If you give us your mobile number or message us, you agree that we may reply and send messages related to your request by SMS or WhatsApp. Message frequency varies. Message and data rates may apply. Reply STOP to stop receiving text messages and HELP for help. Consent to receive messages is not a condition of buying any product or service.
We do not sell, rent or share your mobile phone number or text messaging consent with third parties or affiliates for their marketing or promotional purposes. Mobile information is shared only with the service providers that help us deliver messages (such as messaging platforms and telecommunications carriers).
6. How we share information
We do not sell your personal information. We share it only as follows:
- Service providers that work on our behalf, such as website hosting, email delivery, messaging and communications platforms (including WhatsApp, operated by Meta), AI service providers that power our agents, website delivery, security and bot protection (Cloudflare, whose network every visit to our website passes through), payment processing and accounting. They may use your information only to provide services to us.
- Legal reasons: when required by law, subpoena or court order, or to protect the rights, property or safety of Genial Link, our clients or others.
- Business transfers: if Genial Link is involved in a merger, acquisition or sale of assets, your information may be transferred as part of that transaction.
- With your consent: in any other case, only when you ask us to or agree to it.
7. Cookies and similar technologies
Our website uses a small number of cookies and similar technologies:
- Essential cookies, such as a session cookie that protects our contact form from fraudulent submissions.
- Security services: our website is delivered through Cloudflare, which filters attacks and abusive traffic and may set security cookies (for example, after a bot check). Cloudflare Turnstile checks that form submissions come from real people. Cloudflare processes technical data such as your IP address and browser details for these purposes.
- Fonts are delivered from our own domain through Cloudflare; your browser does not contact Google Fonts.
- Webchat: if you use our webchat, the chat provider may set cookies to keep your conversation open.
We do not currently use advertising cookies. You can block or delete cookies in your browser settings, but some parts of the website, such as the contact form, may not work without them. If we add analytics or advertising tools in the future, we will update this policy.
8. How long we keep information
We keep personal information only as long as needed for the purposes in this policy: for prospects, generally up to 24 months after our last contact; for clients, for the duration of our relationship and as long as required afterwards for legal, tax and accounting purposes. We then delete or anonymize it.
9. Your choices and rights
- Access, correction and deletion: you may ask us what personal information we hold about you, and ask us to correct or delete it, subject to legal exceptions.
- Marketing opt-out: reply STOP to text messages, use the unsubscribe link in our emails, or contact us.
- Human contact: you may ask to speak with a person instead of our AI agent at any time.

We will verify your identity before acting on your request and respond within the time required by applicable law. We will not discriminate against you for exercising your rights.
10. How we protect information
We use reasonable administrative, technical and physical safeguards to protect personal information, including encrypted connections (HTTPS), access controls and spam protection. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you as required by law, including the Florida Information Protection Act (Section 501.171, Florida Statutes).
11. Children's privacy
Our website and services are intended for businesses and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, please contact us and we will delete it.
12. Links to other websites
Our website may link to other websites and services, such as WhatsApp. Their privacy practices are governed by their own policies, not this one.
13. Where we process information
Genial Link is based in the United States, and information is processed in the United States. If you contact us from another country, your information will be transferred to and processed in the United States.
14. Changes to this policy
We may update this Privacy Policy from time to time. The updated version will be posted on this page with a new effective date. If we make significant changes, we will take reasonable steps to let you know.
